We Repair - Terms & Conditions (2011)


Limitation of Liability

We Repair is not responsible or liable for any damages, unseen or otherwise, that may appear during or after the repair of any video game console, PC/Mac laptop computer, Apple device or any other device. Except where prohibited by law, in no event will We Repair be liable to you for any indirect, consequential, exemplary, incidental or punitive damages, including lost profits, even if We Repair has been advised of the possibility of such damages.

Indemnity

You agree to indemnify and hold We Repair, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including attorneys' fees), made against We Repair by any third party due to or arising out of or in connection with your use of the We Repair service.

Violation of These Terms & Conditions

We Repair may disclose any information we have about you (including your identity) if we determine that such disclosure is necessary in connection with any investigation or complaint regarding your use of We Repair 's service, or to identify, contact or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) We Repair's rights or property, or the rights or property of We Repair customers.

We Repair reserves the right at all times to disclose any information that We Repair deems necessary to comply with any applicable law, regulation, legal process or governmental request. We Repair also may disclose your information when We Repair determines that applicable law requires or permits such disclosure, including exchanging information with other companies and organizations for fraud protection purposes.

We Repair determines that such preservation or disclosure is reasonably necessary to (1) comply with legal process, (2) enforce these Terms of Use, (3) respond to claims that any such data violates the rights of others, or (4) protect the rights, property or personal safety of We Repair, its employees, users of or visitors to the Site, and the public.

If We Repair does take any legal action against you as a result of your violation of these Terms & Conditions, We Repair will be entitled to recover from you, and you agree to pay, all reasonable attorneys' fees and costs of such action, in addition to any other relief granted to We Repair. You agree that We Repair will not be liable to you or to any third party for termination of your access to the We Repair service as a result of any violation of these Terms & Conditions.

Warranties are terminated automatically when customers become verebally or physically abusive toward We Repair staff, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates.

Customer Liability

WE Repair customers are required to pay for their game system repairs or modifications within sixty days. All consoles that either have not had their service bill paid or that have not been picked up within sixty days will be resold and all profits made will be kept to claim costs and expenses incurred by WE Repair.

Furthermore, all game systems demeed unrepairable and abandoned by their owners will be donated to Free Geek (a local Vancouver Charity) for electronic recycling.

General Warranty

WE Repair provides a 2 month warranty on all hardware repairs, unless otherwise specified. The We Repair General Warranty covers both parts and labor. We Repair does not offer a warranty on services such as, but not limited too virus/spyware removal, jailbreaking of devices, game system modding, video game console & PC/Mac laptop cleaning and Apple device cleaning etc...

Reflow Warranty

The WE Repair reflow warranty covers the reflow only. Should a reflow fail, the warranty holder may at their discretion bring their game console, laptop or other electronic device back as many times as necessary to have it's GPU processor fixed via reflow; however, should for some reason and at any time the warranty holder's system become nonrepairable via reflow, the customer's warranty becomes null and void.
Warranties are non transferable.

No Refund Policy

WE Repair does not charge for some repair services, when those repairs are deemed not successful; however, in turn We Repair does NOT OFFER REFUNDS on any of the services or products it offers under ANY CIRCUMSTANCE.

Repairs can and will be completed under warranty when applicable, and all products purchased from We Repair can be exchanged under warranty for up to two months from the time they are purchased.

Finally it should be noted that any customer having GPU processor repair carried out (RROD/YLOD/GSOD/BSOD/ETC) runs the risk of ending up in the 1 % of customers that end up with a machine that can not be fixed again when returned under warranty.

Important Wii Modding Information

It should be noted the software used for the different softmod services WE Repair offers is free software, and the prices WE Repair charges is for the installation of that software. Nintendo Wii owners interested in WE Repair modding services should also note that unless a Wii has an older disk drive it will not be able to play back up games from disc and so an external USB hard drive would be required.

Postal Repair | Order Processing & Payment Methods

Once WE Repair has received your broken video game system, laptop or Apple product a WE Repair technician will carry out an inspection. As soon as the inspection is completed, a WE Repair technician will contact you with a price quote for the repair of your game system, laptop or Apple device.

WE Repair postal repair customers are required to pay by check, E(mail)check, online banking or direct deposit. Customers sending an item for a repair are also responsible for all shipping costs. We Repair is not responsible for any items damaged during shipping.
